These terms govern your use of hayahfoundation.com and any project you order through it. By using the site or placing an order, you agree to them. The site is operated by HAYAH FOUNDATION LLC, registered with the Wyoming Secretary of State, United States, under filing number 2026-001961550 (“Hayah Foundation”, “we”).
1. What we offer
On your behalf, we carry out water projects (surface and artesian wells), sacrifices (Sadaqah, Aqiqah and Udhiyah) and well add-ons in the countries where we work. Descriptions, photos, depths and beneficiary numbers on project pages are indicative and can vary with the ground and local conditions.
2. What your payment is for
- Your payment is for us to carry out the project you chose on your behalf and to document it for you.
- Hayah Foundation is registered as a limited liability company. Unless we confirm otherwise in writing, payments are not presented as tax-deductible donations. Please check the rules that apply where you live.
- Once complete, a well is handed over to the benefiting community for public use; you do not acquire ownership of the well or the land. What you receive is the project carried out in your name, with its documentation.
3. Orders, prices and payment
- Prices are set in US dollars. Amounts shown in other currencies are approximate conversions for convenience only; the final amount and currency are shown on the checkout page before you pay.
- A crossed-out price is the project’s previous price. Prices may change, but a change never affects an order you have already paid for.
- Payment is taken through Shopify’s checkout, and your order is confirmed once payment succeeds.
- We may decline or cancel an order — for example because of an obvious pricing error, or because it cannot be carried out — in which case we refund it in full.
4. Well add-ons
Add-ons (the shade canopy, tiling, water buckets, extra tank and the sheep at the well’s opening) are ordered with a specific well and carried out at its site; they cannot be ordered on their own. The sheep is slaughtered at the well’s opening and its meat shared with the village families.
5. The plaque and name
- You can enter a name and choose a dedication wording, or choose “فاعل خير” (an anonymous donor). Plaques are engraved in Arabic.
- You are responsible for the text you provide and confirm you have the right to use any names in it. We may decline, or adjust with you, any text that is offensive, unlawful or unsuitable for a charitable project.
- Where we send you the plaque design for approval, work begins only once you approve it.
6. Project location
You can tell us which country you prefer and we will follow your wish as far as possible, but the final site depends on local need, groundwater and safe access. We confirm the location with you before work starts.
7. Delivery times
- Estimated times: 7–10 days for surface and medium wells, 10–15 days for deep wells and 1–2 days for sacrifices, counted from when the project details (plaque and location) are confirmed.
- Udhiyah sacrifices are made on the Day of Sacrifice and the days of Tashreeq; the Aqiqah date is agreed before payment.
- These are estimates, not guarantees. Work can be delayed by weather, security, access, supplies, public holidays or local authorities; if a delay happens, we tell you as soon as we know.
8. Documentation
- After completion, we send the documentation to your WhatsApp number or the contact details in your order. For wells it usually includes before-and-after photos, a video, a photo of the plaque, the project location, beneficiary details and a completion certificate.
- For sacrifices: photos and videos of the slaughter and distribution, with the plaque visible.
- What is included varies with the type of project and local conditions — exact coordinates, for example, may not be available in some areas.
- Please make sure your number is correct. If documentation does not reach you because of wrong contact details, we will resend it on request.
9. Sacrifices
We choose a healthy animal that meets the Islamic age and other requirements, and specialists slaughter it in the Islamic manner, mentioning the name of the person it is for. The meat is distributed fresh on site to the families most in need, in coordination with local community leaders; none of it is sent to you.
10. After a well is handed over
We hand the well over to the villagers and train them in its basic upkeep; follow-up arrangements vary by well type and region. Because a well depends on groundwater and how it is used locally, we cannot guarantee that it will keep working indefinitely.
11. Cancellations and refunds
- Before work begins — that is, before the plaque is approved, the location confirmed or the animal purchased — you can cancel by contacting us, and we refund the full amount to your original payment method.
- Once work has begun — drilling started, materials bought, or the animal purchased or slaughtered — the order cannot be cancelled or refunded, because the costs have been spent on your project.
- If we cannot carry out the project — because of security conditions or an unsuitable site, for example — we will offer you an alternative site or a project of the same value, or a full refund. The choice is yours.
- We process approved refunds within 14 days; how long the money takes to reach your account depends on your payment provider.
12. Using the site
You agree to use the site lawfully, not to provide false information or impersonate anyone, and not to try to disrupt or break into the site or scrape its content automatically.
13. Intellectual property
The text, photos, videos and logo on this site belong to Hayah Foundation or are licensed to it. You are welcome to share our links and posts with credit, but they may not be used commercially without our written permission.
14. Third-party services
Services such as Shopify, payment providers, WhatsApp and social networks have their own terms and policies, and we are not responsible for the content of external sites we link to.
15. Limitation of liability
We take due care in carrying out every project. To the fullest extent the law allows, we are not liable for indirect losses, or for delays or failures caused by events beyond our reasonable control such as natural disasters, conflict or government action, and our total liability for any order is limited to the amount you paid for it. Nothing here limits rights that cannot be waived by law.
16. Governing law
These terms are governed by the laws of the State of Wyoming, United States. If a dispute arises, please contact us first so we can try to settle it amicably; failing that, the courts of Wyoming have jurisdiction. This does not affect mandatory consumer protections in your country of residence.
17. Changes and language
- We may update these terms; the date of the latest update appears at the top of the page. Each order is governed by the terms in force when it was placed.
- These terms are available in Arabic, English and French. If the versions differ, the Arabic text prevails.
